FAMILY & DIVORCE CASE OPTIONS


All family matters come in two types - Contested and Uncontested.


Uncontested cases are cases where the parties agree on what should happen, with children, a house etc.   Uncontested cases are usually quick and inexpensive.

Contested matters are when any one (or more) issue is not agreed upon.  The courts will see the parties don’t agree completely and will set the case on a different course. 

When children are involved, this will mean two sets of hearings.  Most times there will be one to deal with custody and another to hear everything else.  There is usually a custody evaluation by a social worker, which includes a home visit, and it often includes parenting classes and mandatory mediation sessions. 

There often end up being 6-10 court appearances and tons of paperwork and info to exchange between the lawyers.  It get very expensive, and takes a very long time. Due to this, it is almost always advisable to reach some kind of agreement with the other side, and we always explore that both at the beginning and all throughout the case as it progresses.
